These Terms govern your access to and use of the PreStart360 Services provided by Commodo Pty Ltd (“Commodo”). By using the Services, you agree to these Terms.
You are responsible for safeguarding your credentials and ensuring users comply with these Terms. You must provide accurate account information and promptly notify us of unauthorised use.
You retain all rights to content you submit (“Customer Data”). You grant Commodo a limited licence to process Customer Data to provide and improve the Services. You are responsible for obtaining consents and ensuring your use complies with applicable laws.
You will not misuse the Services, attempt to access them by unauthorised means, or interfere with their operation. You will not submit unlawful, harmful, or infringing content.
Fees are as set out on our website or order form and are payable in advance unless stated otherwise. Prices are exclusive of GST. Subscriptions renew automatically unless cancelled per the order form. Late payments may result in suspension.
We aim to provide reliable Services and reasonable support during business hours. From time to time, maintenance windows may occur.
Each party agrees to protect the other’s confidential information with reasonable care. We implement safeguards designed to protect Customer Data.
The Services are provided “as is”. To the extent permitted by law, Commodo disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement.
To the extent permitted by law, Commodo’s aggregate liability arising out of or related to the Services is limited to the amounts paid by you in the 12 months preceding the event giving rise to the claim. Nothing limits liability that cannot be excluded by law.
You may terminate per your plan terms. We may suspend or terminate for material breach or unlawful use. Upon termination, your access ends and we will handle Customer Data per our retention and deletion policy.
All rights in the Services and related materials remain with Commodo and its licensors.
These Terms are governed by the laws of Victoria, Australia, and the parties submit to the exclusive jurisdiction of its courts.
